Adams United Lawyers

At Adams United Lawyers, we provide clear, fast, and fully compliant Independent Legal Advice (ILA) for all Binding Financial Agreements, Prenuptial & Postnuptial Agreements, Cohabitation Agreements, Separation BFAs, and Consent Orders.

We offer fixed-fee independent legal advice with a 24-hour turnaround so you can finalise your agreement confidently and legally.

Why Independent Legal Advice Is Required

Under the Family Law Act 1975, a Binding Financial Agreement is only legally enforceable if both parties receive independent legal advice from separate qualified solicitors.
This advice must cover:

  • Whether the agreement is to your advantage or disadvantage
  • The effect of the agreement on your rights
  • Whether entering into the agreement is prudent
  • Your solicitor providing a signed advice certificate

If these steps are not followed, the agreement may be challenged or set aside later.

Our Fixed-Fee Independent Legal Advice Package

We offer clear, simple pricing with no hidden fees:

Independent Legal Advice & Review — $990 fixed fee (inc GST)

You receive:

  • Full review of the drafted BFA or proposed BFA
  • A detailed written assessment of each clause
  • Explanation of risks, obligations, and legal effect
  • Negotiation points (if required)
  • A signed Independent Legal Advice Certificate
  • 24–48 hour turnaround
  • Australia-wide service (phone or Zoom)

This service applies to:
s 90B (prenup), s 90C (during marriage), s 90D (separation), s 90UC (de facto), s 90UD (post-separation de facto).

When You Need Independent Legal Advice
You require ILA if:

  • You’ve been given a Binding Financial Agreement to sign
  • You’re entering a prenup, postnup, or cohabitation agreement
  • You’re signing a separation BFA after a relationship breakdown
  • Your partner’s lawyer has drafted an agreement you must have independently reviewed
  • You want to avoid court proceedings and ensure the BFA is watertight

If you are drafting and reviewing at the same time, you will need two separate lawyers — we can refer an independent review solicitor if your partner is using Adams United Lawyers.
