Why Independent Legal Advice Is Required
Under the Family Law Act 1975, a Binding Financial Agreement is only legally enforceable if both parties receive independent legal advice from separate qualified solicitors.
This advice must cover:
- Whether the agreement is to your advantage or disadvantage
- The effect of the agreement on your rights
- Whether entering into the agreement is prudent
- Your solicitor providing a signed advice certificate
If these steps are not followed, the agreement may be challenged or set aside later.
