Our Fixed Fee Divorce Service
✔ Divorce Application – $770 (inc GST) + Court Filing Fee
This includes:
- Preparation of your sole or joint divorce application
- Filing the application through the Commonwealth Courts Portal
- Guidance on serving documents (if sole application)
- Assistance with “separated under one roof” evidence
- Confirmation of hearing or electronically-determined outcome
- Support until the Divorce Order becomes final
Court Filing Fees
The Federal Circuit and Family Court charges a filing fee. As at 2025:
- Standard filing fee: $1,125
- Reduced fee (if eligible): $350
We will let you know whether you qualify for the reduced fee.
Who Can Apply for a Divorce?
You can apply for a divorce in Australia if:
- You have been separated for 12 months or more
- You regard the relationship as over
- You or your spouse is an Australian citizen, lives in Australia, or intends to live here permanently
You do not need to be separated physically.
If you lived together in the same home after separation, you may still apply — this is called separated under one roof.

Joint Application
- No service required

Sole Application
- You must “serve” the other party
- They cannot block or stop your divorce
- We guide you through service rules (including special service if needed)
What If You Have Children?
The court must be satisfied that proper arrangements are in place for children under 18.
This includes:
- Schooling
- Housing
- Health
- Financial support
- Time with each parent
Parenting Plans & Arrangements
Do You Need a Property Settlement?
The divorce process does not deal with property or money.
You have 12 months after your divorce becomes final to finalise your asset division.
If you want your financial settlement sorted now, we can prepare:
- Binding Financial Agreement (fastest, private, enforceable)
- Consent Orders (filed with the Court)
Domestic Violence & Safety Considerations
If family violence is a factor, the court can allow alternative service methods. Your safety is the priority.
